Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Buffalo Power Solutions ("Company," "we," "us," or "our") concerning your access to and use of our website buffalopowersolutions.com and our services.
By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access the website or use our services.
Services
Buffalo Power Solutions provides generator installation, maintenance, repair, and related services ("Services") to residential and commercial customers in Texas. All Services are subject to availability and are provided according to our standard terms and conditions of sale, which will be provided in writing prior to the commencement of work.
Quotes and Estimates
Pricing information provided on our website or verbally is for general reference only and does not constitute a binding quote or offer. All quotes and estimates are:
- Subject to site inspection and assessment
- Valid for 30 days from the date of issuance unless otherwise specified
- Subject to change based on actual conditions, material costs, and scope of work
- Provided in writing and must be signed to constitute an agreement
- Subject to applicable taxes, fees, and permits
No work will commence without a signed agreement and, where applicable, payment of required deposits.
Payment Terms
Payment terms will be specified in your service agreement. General payment policies include:
- Deposits may be required before work commences
- Payment is due upon completion of work unless other arrangements are made in writing
- We accept cash, check, and major credit cards
- Late payments may be subject to interest charges as permitted by law
- Non-payment may result in filing of mechanic's lien or legal action
Scheduling and Appointments
We make every effort to arrive for scheduled appointments within the agreed time window. However, service times may be affected by weather, emergency calls, traffic, or other unforeseen circumstances. We will make reasonable efforts to notify you of any significant delays.
If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.
Warranties and Guarantees
Workmanship Warranty
We warrant that all work will be performed in a professional and workmanlike manner in accordance with industry standards. Any defects in our workmanship will be corrected at no charge if reported within the warranty period specified in your service agreement (typically one year from completion).
Equipment and Parts
Equipment and parts are covered by the manufacturer's warranty. We are not the manufacturer and do not provide warranties beyond those provided by the manufacturer. We will assist with warranty claims as needed.
Warranty Exclusions
Our warranty does not cover:
- Damage caused by improper use, negligence, or abuse
- Failure to follow manufacturer's maintenance requirements
- Damage from acts of God, natural disasters, or severe weather
- Normal wear and tear
- Work or modifications performed by others
- Failure to provide proper operating environment for equipment
Customer Responsibilities
As a customer, you agree to:
- Provide safe and clear access to work areas
- Inform us of any known hazards or special conditions
- Secure pets and ensure they do not interfere with our technicians
- Follow all manufacturer maintenance requirements for installed equipment
- Contact us immediately if you notice any problems with installed equipment
- Provide accurate information about your property and electrical systems
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUFFALO POWER SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use our services
- Any conduct or content of any third party
- Any content obtained from our website
- Unauthorized access, use, or alteration of your transmissions or content
Our total liability for any claims arising out of or related to our services shall not exceed the amount you paid us for the specific service giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Buffalo Power Solutions and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or violation of these Terms.
Permits and Code Compliance
We will obtain all necessary permits for work performed under our service agreements. All work will be performed in accordance with applicable building codes and regulations. However, we are not responsible for pre-existing code violations or conditions that do not meet current codes unless specifically contracted to remedy such conditions.
Emergency Services
Emergency service is provided on a best-effort basis and is subject to technician availability, weather conditions, and other factors. Emergency service rates apply to after-hours, weekend, and holiday service calls. We do not guarantee specific response times for emergency calls.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Buffalo Power Solutions or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from our content without our express written permission.
Dispute Resolution
Informal Resolution
If you have any concerns or disputes, please contact us first so we can attempt to resolve the issue informally. We are committed to customer satisfaction and will work in good faith to resolve any problems.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Jurisdiction
Any legal action or proceeding arising out of or relating to these Terms shall be instituted in the state or federal courts located in Brazos County, Texas. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after any changes constitutes acceptance of the new Terms.
Entire Agreement
These Terms, together with any service agreements and our Privacy Policy, constitute the entire agreement between you and Buffalo Power Solutions regarding the use of our website and services, and supersede all prior agreements and understandings.
