NFPA 110 Compliance in Texas: What Facility Managers Actually Need to Know

If your building has an emergency generator, NFPA 110 is the standard your inspectors, your insurance carrier, and, if you're a healthcare facility, the federal government use to judge whether that generator counts as reliable emergency power or an expensive lawn ornament.

Here's the problem: most facility managers inherit a generator, a maintenance contract of unknown quality, and a binder that hasn't been opened since the last inspection. Then the fire marshal shows up, or an accreditation surveyor asks for run logs, and the scramble starts.

What NFPA 110 is, and who enforces it in Texas

NFPA 110 is the Standard for Emergency and Standby Power Systems. It covers the installation, maintenance, operation, and testing of Emergency Power Supply Systems (EPSS), your generator, its transfer switches, fuel system, batteries, and everything between the engine and the loads it protects.

NFPA 110 isn't a law by itself. It becomes enforceable when a code adopts it, and in Texas, that happens locally:

  • Most Texas cities enforce a locally amended edition of the International Fire Code (IFC), which requires emergency and standby power systems to be maintained and tested in accordance with NFPA 110. Houston, Austin, Dallas, San Antonio, and most mid-size cities all follow this pattern, but each city adopts its own edition, with its own amendments.
  • Your enforcement contact is the local Authority Having Jurisdiction (AHJ): usually the city fire marshal's office. Two buildings 20 miles apart can answer to different fire codes and different inspectors.

  • Some water and critical infrastructure operators have state-level obligations too: after Winter Storm Uri, Texas Senate Bill 3 (2021) required affected water utilities to build emergency preparedness plans that ensure continuous operation during outages, which for many systems means standby power.

The two system levels

NFPA 110 classifies systems by what happens if they fail:

  • Level 1: failure could result in loss of human life or serious injury. Hospitals, high-rise egress systems, emergency lighting circuits, fire pumps served by generator power.
  • Level 2: failure is less critical to life safety. Many commercial standby applications.

Level determines how strict the requirements are. If you don't know your system's level, that's the first question to answer, it's the lens your inspector uses.

The testing and maintenance schedule that keeps you compliant

This is the core of NFPA 110 Chapter 8, and it's where most facilities fall out of compliance:

Weekly: inspect the EPSS. Fuel levels, battery charger, block heater, leaks, alarms, switch positions. A walkthrough with a checklist, but it must be documented.

Monthly: exercise the generator under load for at least 30 minutes. For diesel units, the loading needs to reach at least 30% of the nameplate kW rating (or maintain the exhaust gas temperature the manufacturer recommends). A no-load "hum test" does not count, unloaded running actually harms diesel engines over time (wet stacking).

Monthly: operate each automatic transfer switch (ATS), transferring load to confirm the system actually picks up the building.

Annually: if your diesel generator can't reach that 30% load during monthly tests (very common in buildings where the generator is oversized), NFPA 110 requires a supplemental annual load bank test: roughly 1.5 continuous hours at escalating load, the exact profile is in the standard, and we cover it in detail in our load bank testing guide.

Every 36 months: Level 1 systems require an extended endurance test: a minimum 4-continuous-hour load test, proving the system can carry a real outage, not just a Tuesday morning exercise.

Ongoing: fuel quality testing for stored diesel (stored fuel degrades; a full tank of bad fuel is a failed generator with extra steps), battery maintenance, and manufacturer-required service intervals.

Documentation: the half of compliance everyone skips

When an inspector or surveyor evaluates your program, they don't watch your generator run, they read your records. NFPA 110 requires written records of inspections, tests, exercising, operation, and repairs. That means:

  • Dated logs for weekly inspections and monthly tests, with load readings, not just "ran fine"
  • ATS transfer records
  • Load bank test reports with load steps and readings
  • Fuel test results and corrective actions
  • Repair records showing that identified deficiencies were actually closed out
